US government limits immigrants arrest at schools, daycares, hospitals, churches, and other ‘Protected’ Areas
In the latest news on reparations for illegal immigration in reforms, U.S. immigration authorities will limit arrests at schools, hospitals, and other “protected” areas under guidelines issued by the Department of Homeland Security, part of a broader effort to roll back the approach to enforcement under President Donald Trump.
The memorandum from DHS Secretary Alejandro Mayorkas outlining the policy directed agents and officers to avoid making arrests or carrying out searches at a range of sensitive locations “to the fullest extent possible.
In a series of immigration policies under US President Joe Biden aimed at taking a more targeted approach to enforcement. The policy is similar to one under President Barack Obama that restricted arrests at churches and schools.
The new policy includes not just schools but medical and daycare facilities, playgrounds, churches, hospitals, and recreation centers as well as demonstrations and rallies.
Guidelines issued earlier this year for immigration reforms enforcement directed agents to focus on recent border crossers, national security threats, and people who have committed serious crimes rather than arrests of illegal immigrants at ‘protected’ areas. DHS also imposed limits on arrests at courthouses when people showed up for other matters and ended mass worksite raids.
Mayorkas has debated that his agency does not have the resources to pursue all of the estimated 11 million people in the country without legal status deemed illegal migrants but rather focus on those who pose the greatest risk to society.
In announcing part of the new immigration reforms guidelines, the secretary said agents and officers should consider “broader societal interests” and the impact of their activities on communities.
The Department of Homeland Security secretary reiterated that they could accomplish our law enforcement mission without denying individuals access to needed medical care, children access to their schools, the displaced access to food and shelter, people of faith to access to their churches, places of worship, and more.
The list of protected areas includes broad categories such as “a place where children gather” and “a place where disaster or emergency response and relief is being provided,” an expansive policy that marks a significant shift for an agency that includes U.S. Immigration and Customs Enforcement, which some immigrant advocates want to see abolished altogether.
Children who entered with those adults were separated from them and placed into the custody of the Department of Health and Human Services. The separations occurred with no process for reuniting the families, as some parents were deported. President Trump later ended the policy in an executive order on June 20, 2018.
While US immigration policy reform for illegal immigrants has both praises and criticism from different groups. it also further alienated Biden critics who say weaker enforcement encourages migrants to seek to enter the country illegally. The Trump administration sparked criticism for seeking to arrest and remove anyone in the country illegally regardless of criminal history or community ties, though DHS also operated under a sensitive locations policy that limited enforcement actions in churches and other places.
Exceptions include when the action involves a national security threat; if there is an imminent risk of death, violence, or physical harm to a person; if it involves the “hot pursuit” of someone who poses a public safety threat and someone who was personally observed crossing the border illegally

A new report shows that the Biden administration is considering about $450,000 per person in total compensation that could cost more than $1 per person as reparation for families of illegal immigrants split along the southern border under the Trump administration – a total payment that would cost the government $1 billion, according to a new report.
According to National Review, sources told the Wall Street Journal that the lawsuits demand a range of payouts, with the average request being about $3.4 million per family. Lawyers for the families and the government have told courts that they hope to reach a deal by the end of November while some government lawyers see the reparation payouts as excessive for illegal immigrants who broke the law by crossing the border, the report says.
People familiar with the matter told the Wall Street Journal that the U.S. Department of Justice, Homeland Security, and the Department of Health and Human Services are considering payments in the process of resolving lawsuits alleging the government has caused long-term psychological trauma to parents and children.
The lawsuits claim the separations caused lasting mental-health problems for the children from the trauma of months spent without their parents.
Lee Gelernt, deputy director of the ACLU’s immigrant-rights project and a lead negotiator on one of the lawsuits, argued that the remedy for the separated families “must include not only meaningful monetary compensation but a pathway to remain in the country,” according to the report.
Gelernt also noted that President Biden has agreed that the family separation policy is a historic moral stain on our nation that must be fully remedied
